PRICE LIST and Rules of Order at the Anchorage for 2025.
Based on the provisions of the Act on Crafts of the Republic of Croatia and the Decision on the Price List for the Newly Regulated Anchorage from 2025, Niko Milina, owner of the craft NIKO, with headquarters in Lumbarda No. 191. , concession holder for the anchorage Gavuni Lumbarda island of Korčula, OIB; 51602700989, (the concession is granted by the PORT AUTHORITY of the Dubrovnik-Neretva County), (hereinafter referred to as the Owner of the anchorage system) adopts this price list and the Regulations on the Order at the Anchorage.
Article 1. The Owner of the anchorage system establishes a price list for users of the newly arranged anchorage system organized through mooring devices (buoys), all in accordance with the design and capacity of the anchorage system: BOAT LENGTH ( LOA) THE AMOUNT OF THE FEE PER METER DAILY is 5 EUR (five EUR per m). Prices are expressed in EUR per indivisible day and the length of the boat overall (LOA) specified in the valid documentation of the vessel. Payment for the use of the regulated anchor system is made in cash. VAT is included in the price. Other options for the price of a berth at the anchor per meter of the vessel's length; - monthly in summer 60 e, - monthly in winter 38 e, - annually 183 e, - summer for 6 months 128 e., - winter for 6 months 110 eur.
Article 2. The price includes mandatory assistance from authorized persons for the safety of the berth at the regulated anchor system and the service of collecting and depositing municipal (dry) waste from the vessel. Mooring of the tender of the inflatable boat to the emergency berth of the anchorage in front of the Gavuni tavern is included in the price. Transfer of the user of the anchor system (marine transport) from the vessel on the arranged anchor system to the emergency berth in front of the Tavern Gavuni or another location is not included in the price. Water consumption for standard vessel needs is not included in the price and is charged additionally at a price of 20 eur per.filling..Electricity.consumption.is.not.offered.
Article 3. The owner of the anchor system reserves the right to move the user's vessel to a new anchor berth for safety or other justified reasons, with prior notice to the service.user.
Article 4. The owner of the anchor system reserves the right to prohibit the use of the anchor system by the owners or lessees of the vessel in the event of disturbance of public order, environmental pollution or the detection of other activities that disturb other users of the anchor system or put the safety of the vessel, property, persons, etc. at risk. During the use of the anchor system, it is prohibited to throw and discharge into the sea all solid and liquid waste and wastewater from the so-called "black tank". Violation of the provisions on the protection of the marine environment is strictly punished in accordance with the provisions of the Maritime Code and.the.Act.on.Maritime.Property.and.Seaports.
Article 5. The owner of the anchor system reserves the right to permanently prohibit the use of the anchor system by the owners of the vessel in the event of frequent violations of public order, environmental pollution or failure of the vessel user (lessee) to act in accordance with the instructions of the authorized persons of the owner of the anchor system.
Article 6. Every service user who records any damage to a vessel at a regulated anchorage is obliged to report it without delay to the Owner of the anchor system and the competent Port Authority, Korčula Branch, all in writing, in order to undertake investigative actions to determine the damage caused. In the event that damage is determined to have been caused by the user of the anchor system, the owner of the anchor system shall undertake all legal activities with the competent authorities and carry out the procedure for determining the liability of the user of the anchor system service and the amount of damage.
Article 7. If an authorized official of the Owner of the anchor system determines by direct observation that the user of the regulated anchor system is in any way endangering third parties or property, he is authorized to issue an oral warning to the perpetrator prohibiting further risky behavior. If, after being warned, the user of the regulated anchor system continues to carry out risky activities for the safety of property and other persons, the authorized person of the Owner of the anchor system is authorized to charge a one-time fine of EUR 500.00 (including VAT) and immediately report the said vessel and the perpetrator to the competent Port Authority of Korčula Branch Office, along with the delivery of a written statement regarding the incident in question.
Article 8.The owner of the anchor system is not responsible for damage resulting from events that are not consequential and directly related to the use of the anchor line, and in particular:
1. damage to the vessel that is the result of unprofessional management of the vessel when using the moorings (e.g. due to refusal of assistance from the authorized official of the Anchor System Manager in the mooring of the vessel, due to moving the vessel to another anchorage without the knowledge of the authorized person of the Manager, etc.)
2. obstruction of the movement of vessels on the waterway
3. damage or risks caused by the lack of supervision of the vessel by the master of the ship ./.or the master of the yacht / or the master of the boat
4. damage to third parties, and persons swimming in the sea, due to careless and unprofessional.use.of.moorings,
5. damage that occurs as a result of a collision with another vessel,
6. burglary, theft of the vessel or vessel equipment,
7. fire on the vessel, lighting a fire
8. damage caused by faulty electrical and water installations
9. hidden defects of the vessel,
10. damage based on loss of earnings, time, delay, use of vacations, etc.
11. damage due to force majeure (extreme weather conditions, etc.)
12. damage resulting from arbitrary mooring of the vessel without the assistance of an authorized person of the owner of the anchor system,
13. lack of daytime markings and lights on the vessel, in accordance with the International Rules for Preventing Collisions at Sea.
